How to ensure you receive missed alimony payments

If you have been awarded a series of alimony payments from your ex-spouse in the state of Rhode Island, it is likely that you will be heavily dependent on these payments so that you can maintain your lifestyle.

Making the transition to becoming financially independent after a divorce can be very challenging, especially if you contributed to your marriage in nonfinancial ways, such as through caring for the children. This is why it is important that you stand up for your right to receive alimony in Rhode Island.

What are the consequences of not paying alimony?

If your ex-spouse has missed an alimony payment, they are violating the ruling that was made in court. In order to enforce the payment, you can begin by filing a Complaint for Contempt in the original court. If your ex-spouse has a valid reason for not paying the alimony owed, for example, if they lost their job, the court may modify the ruling to make the payment obligations fairer.

However, if there is no good reason why your ex-spouse is not paying the alimony owed, interest on the arrears may be implemented, as well as an order to make all missed payments. If these attempts to recoup the missed payments are not successful, wage garnishment may be implemented so that you can receive the financial support that you are entitled to.
